Lewes man struck on U.S. 40 in Bear in critical condition

BEAR, DELAWARE (8/8/2015) A 60-year-old Lewes man was in critical condition after being struck by a car while walking across U.S. 40 in Bear, Delaware State Police said this morning.

A second vehicle swerved to miss the victim in the roadway and struck the first car.

The crash happened about 11:15 p.m. in the westbound lanes on Pulaski Highway (U.S. 40) near Rickey Boulevard and the Fox Run Shopping Center.

The pedestrian, identified as Anthony J. Jenkins, was treated at the scene and taken by Delaware State Police helicopter to Christiana Hospital.

Police said he was not in a crosswalk nor carrying a flashlight.

He was struck by a 2001 Nissan Altima in the right lane. The driver, Thomas A. Tartaglio, 56, of Newark, attempted to avoid the pedestrian but struck him with the front bumper, causing him to roll up onto the hood and strike the windshield before being thrown back into the roadway, police said.

Tartaglio was able to stop the Nissan in the right lane, but moments later a westbound Chevrolet Silverado pickup truck, trying to avoid Jenkins and the Nissan, struck the rear bumper of the car.

Neither the driver of the truck, James D. Rosseel, 44, of Bear, nor Tartaglio were injured. Police said both were wearing seat belts.

State police are still investigating the crash but said alcohol is not believed to be a factor and no charges have been filed.

Christiana Fire Company also responded.

The westbound lanes of U.S. 40 were closed about three hours as police investigated.
