GEORGETOWN, DELAWARE (5/21/2015) The way has been cleared for a long-fought 100-foot cellphone tower proposed near Bethany Beach.

Sussex County Council decided this week not to appeal a Superior Court decision that reversed a Board of Adjustment rejection of the AT&T monopole.

County spokesman Chip Guy said the 3-2 vote on Tuesday against appealing the decision came on the advice of legal counsel.

Council members Rob Arlett and George Cole cast the two votes favoring an appeal by the county.

The cellphone structure was first proposed in 2009 and went through a series of county approvals and rejections and court decisions. Area residents had opposed it.
